How do I make a car accident claim?

It's very simple and in most cases can be done over the phone. If my accident happened at work and I make a claim against them, can they dismiss me?

It is not legally justifiable for your employer to dismiss you for making an accident claim. It could amount to unfair dismissal. Also it's important to remember that your employer is required by law to take out insurance cover against staff accidents. This means that your employer's insurance company will pay your compensation, and not your employer.

Do I need to have attended my Doctor or the Hospital?

If you have not attended your doctor or the hospital it should not stop you from making a claim for the injury you have suffered. It would however, greatly assist your claim if you have a written record of your injury at either your GP or hospital. Regardless of whether you have seen a medical expert, you can still claim for personal injury compensation. That said, it would be beneficial to have a written record of your injury with the doctor who has been treating you.

Will my car accident claim go to Court?

The majority of car accident claims are dealt with without going to Court. It is unlikely that your claim will be taken to Court as the law encourages both parties to reach agreement outside of Court.

What happens if my case is unsuccessful?

We accept cases that have a high prospect of success. This is because the solicitors take on a risk as they do not get paid unless the case is successful. This therefore means that they need to assess your case very carefully before accepting it.
However if the case goes on to become unsuccessful, then you are covered by an insurance policy which the solicitor will purchase on your behalf - so if the case goes to lose, then they will be able to recover any costs from it.

Do I need to pay for Replacement Vehicle?

The cost of this service will be recovered from the insurance company of the person who caused the accident. This means if you have comprehensive insurance, you won’t have to claim on your insurance, and your no claims discount will be unaffected. Plus, to save you further hassle and inconvenience, we’ll deliver and collect the replacement car at a time and place which is convenient to you. Again, you will not be charged for any these costs.
